Visitation Restored to Father

The Edmund Law Firm successfully represented a father’s rights to his children and we received a favorable ruling from the Family Law Court in Vista, California. FAMILY LAW MATTER- MODIFICATION OF SUPPORT

Favorable Decision in Contempt & Child Support Case

The Edmunds Law Firm won an important court decision on a Contempt and Child Support case heard in the Vista Family Law Courts. Appearing for the Firm was attorney Kim Soule. The case involved 36 counts of contempt and an allegation of $17,000 in support arrears.

After considering evidence and oral arguments the judge denied both the arrears and denied each of the contempt allegations. Our client walked away with a support Order of $0. Our client also did not go to jail on the contempt charges nor pay any costs or legal fees for the contempt to the county.

The issues involved spousal support, child custody and visitation by a physically aggressive father. The Firm represented the mother of two children.

The case was successfully litigated by Attorney Neinas on a number of important issues. After a previous hearing involving a deficient FCS report, the court ordered that a new FCS report be obtained. This report, along with the aggressive arguments by Attorney Neinas resulted in the court ruling in favor of the mother to retain custody of the two children, prevented the father from overnight visitation, and ordered the father to pay child support, spousal support, and attorney’s fees. The court denied all of the father’s requests.

SAN DIEGO, CALIF MOTION TO WITHDRAW FROM MEDIATION

DIVORCE FAVORABLE DECISION – CUSTODY & VISITATION

The Edmunds Law Firm received a huge victory following a contested divorce trial held in the South Bay court in San Diego. Attorney Greg Garrison appeared for the Firm. Favorable Decision

April 2013
The firm recently won an ex parte request for our client, Father, who simply wanted to spend a week’s holiday with his two children at a ski resort. The parties had been separated for 8 months, during which time Father was deployed as he is active-duty military. Father only had one precious week of leave, which he wanted to spend with the children. Mother did not want Father to spend the time with the children, instead insisting that his time be either supervised or that he return the children by 6 pm during the week. Mother claimed that Father had alcohol problems, when Father had no DUIs nor reprimands from his command. The court granted Father’s request despite vigorous argument from Mother’s attorney, and allowed Father to spend the week with the children at the resort, and cautioned Mother to prepare the children for the trip accordingly.


February 2013 – DCSS Child Support Modification and Arrears. Client had filed a motion for child support modification in 2011. The case was continued multiple times. The opposing party attempted to portray client as hiding his income and of having an income much higher than that declared, by hiring a private detective and filing numerous unfounded declarations. Despite our client having an established education and career path, the opposing party also tried to impute higher income by retaining a vocational evaluator. We were able to negotiate a child support amount, including a reasonable repayment plan for arrears that included interest on arrears at zero for the time period when our client was not working, thereby savings thousands in additional court fees and finally bringing closure for our client.


In December 2012, Attorney Paula Phinney of The Edmunds Law firm won another move-away case on behalf of the non-custodial parent/father after a two-day trial. Custodial parent/mother wanted to relocate to New York with the parties’ 4 children and wanted an award of child support, spousal support and attorney fees. Our client, the non-custodial parent objected to the move-away request. The court took into consideration the quality of schools in San Diego county versus the schools in New York, the custodial parent’s true reasons for the move, the custodial parent’s history of alcohol consumption and lack of efforts to find work, and denied the request to move-away, and also denied the request for spousal support and attorney fees.


In October 2012, Attorney Paula Phinney of The Edmunds Law Firm attended a hearing on child support, custody and spousal support, and was able to settle the entire matter, including division of assets and debts, thereby saving money for the client and keeping the case within the client’s budget for legal representation while achieving her stated goals for custody and support.


On October 4, 2012, Attorney Paula Phinney of The Edmund Law Firm successfully argued and won a move-away case to Guam against the non-custodial parent’s strenuous objections and opposition. Client/Mother was engaged to be remarried and her fiancé was stationed in Guam as he was in the military. Child in question was three years old.

A favorable outcome was awarded to our client in North County regarding the visitation of her child. Our client had been deployed and the opposing party was not allowing contact between our client and his child. Our client returned from deployment and after numerous requests, the opposing party was avoiding our client and refused to arrange time for him to see his child. During an ex parte hearing the judge awarded a positive decision to our client granting him a week worth of visits with the child prior to his next deployment. Additionally, our client was granted the ability to Skype with his child while deployed so they could continue bonding with each other. Our client was ecstatic.

The Edmunds Law Firm was awarded a favorable decision on a Request For Order hearing in North County regarding the custody and visitation of our client’s children. The opposing party lives out of state and wanted visits with his children, but had not seen them in over four years. The court awarded supervised therapeutic visits for the opposing party. Future visits were ordered to be supervised before moving to unsupervised in San Diego. Additionally, the costs of the supervised therapeutic visits were to be paid for by the opposing party. Our client was ecstatic with the outcome.

Dad filed an Order to Show Cause in Vista Court to modify current custody and visitation order. The Edmunds Law Firm filed a companion Order to Show Cause for a move away request for mom. Mom is primary care giver. On 7/3/12, The Edmunds Law Firm appeared to defend dad’s request for modification of custody and visitation and argued our request for a move away. Judge issued written decision granting mom’s request to move with child to Arizona and denied dad’s request to modify custody and visitation.

The Edmunds Law Firm was retained by mom for a post judgment move away request to Japan. Mom is primary care giver. Order to Show Cause motion was filed in El Cajon. On 7/17/12, The Edmunds Law Firm successfully argued the move away request and the Judge granted mom’s request to move to Japan with the child.

The Edmunds Law Firm was retained by wife for a post judgment modification of spousal support. Order to Show Cause motion was filed in Vista. Wife was paying spousal support to husband. Wife was diagnosed with mental health issues and was forced to leave her job and go on disability. On 7/16/12, The Edmunds Law Firm successfully argued the Order to Show Cause and spousal support was set at zero and terminated.

The Edmunds Law Firm was retained by dad for a dissolution action in Vista Court. On 6/14/12, Attorney Paula W. Phinney of The Edmunds Law Firm attended a Mandatory Settlement Conference and successfully negotiated and resolved all issue in the matter, including negotiating a spousal support order for 3 years only on a long term marriage payable from dad to mom. The marriage was long term lasting 16 years.

The opposing party was allowing their new husband, who is an illegal and undocumented alien, to drive the children places. The opposing party, after numerous requests, had not provided proof of license or proof of insurance. The opposing party was not allowing our client medical information, which he has rights to. During an ex parte hearing the judge awarded a positive decision to our client ordering that the children are only to be driven by a licensed and insured driver, and to share doctor and medical information of the children. This was a very important win to our client and he is very pleased.

The Edmunds Law Firm was awarded a favorable decision, for child and spousal support as well as custody and visitation at the Downtown Family Law Court. The opposing party was only paying $2,000 in support and our attorneys were able to get the client another $1,000, bringing her support up to $3,000. The outcome of the hearing was in our client’s favor, and she was very pleased.

On December 13, 2011 the Law Firm received a favorable decision due to the outstanding trial advocacy of attorney Steve Smith with the firm. Attorney Smith appeared in a Civil Court for a Civil Restraining Order and at the conclusion of the moving parties evidence made a motion for a Directed Verdict.

A Directed Verdict is a highly unusual motion to make and simply states to the Court that the opposing party did not prove their case and the trial should not proceed. Mr. Smith’s motion was granted and thus our client saved a tremendous amount of time, money and anxiety. The Law Firm did not have to present any witnesses or offer any evidence. The Court concurred with Mr. Smith’s summary that the opposing party did not prove their cause of action and the Court granted a favorable decision for our client.

On July 20, 2011The Edmunds Law Firm obtained favorable orders from the court on a child support and child custody case that had been litigated for more than two years. The Edmunds Law Firm Attorney obtained orders changing custody of the children to his client as a result of the Mother’s recurring substance abuse issues. The Court also ordered the Mother to pay child support despite an argument made by her attorney that she did not have the ability to earn income. Both the client and the Edmunds Law Firm were pleased with the judge’s decision.

On July 19, 2011, during an emergency hearing The Edmunds Law Firm obtained court order granting sole physical and legal custody to his client and an order terminating visitation with the other parent pending examination and input from a mental health professional. Over objections from the opposing council, our attorney effectively strongly argued that any exposure to the other parent was detrimental to the welfare of the children. The court agreed and ruled in favor of The Edmunds Law Firm client who was pleased with the court’s decision.

At a hearing on May 26, 2011, The Edmunds Law Firm argued on a request for the Court to vacate unfair support and attorney’s fees orders made against a service member while he was on deployment. Our attorney was able, not only to have the orders for child support, spousal support and attorney’s fees reversed, but he obtained an order reducing the amount of support by over 40% by arguing that the other parent had the ability to earn much more income than she claimed that she could earn.

Attorney Krystal Limon successfully argued the division of a military retirement on March 2, 2011. This matter was held at the San Diego Superior Courthouse, North County Division. This case involved the division of a military retirement as well as repayment of arrears from the date of retirement. The parties were divorced in 1994. In 1997, the parties entered a stipulation regarding division of assets and debts. As part of this agreement, the Wife’s interest in the Husband’s military retirement was to be calculated by Wife’s attorney and submitted to the Husband’s attorney who was to draft the final judgment. Neither party’s attorney followed through. Husband retired from the military in 2007 and began taking monthly payments. Wife retained The Edmunds Law Firm in October 2010.

Husband raised the issue Laches. Husband argued that Wife’s unreasonable delay in pursuing the division should prohibit her entitlement to arrearages. Husband claimed that Wife’s attorney should have finalized the division in 1997. He also claimed that Wife took no action between 1997 and 2007 to insure the division. Additionally, Husband also claimed that Wife was informed when he retired and again took no action. Husband cliaimed Wife’s first request to divide the retirement was in October 2010. Wife claimed she was not informed until 2009 of Husband’s retirement, and that since that time she attempted on several occasions to discuss with him and he would not agree to the division.

At the evidentiary hearing, live testimony was heard from both parties. The Court denied Husband’s Laches defense, and found that Wife was owed arrears from the date of Husband’s retirement to the present for her portion of the retirement. The Court also confirmed Wife’s monthly interest in the retirement going forward. The Court also ordered Husband to contribute $750 to Wife’s attorney’s fees.

The Edmunds Law Firm successfully settled all issues on March 2, 2011 in a dissolution matter. This was a marriage of two years wherein the Husband brought in excess of $70,000 of debt into the marriage. Husband’s counsel adamantly demanded that half of the debt be assigned to the Wife, made very low offers for spousal support and demanded that the Wife return the $12,000 engagement ring to Husband.

The case was litigated for several months as Husband and his counsel would not budge from their position. After argument regarding law and a potential favorable result for Wife at trial, the case resulted in settlement wherein Husband assumed all the debt including two years of unpaid income tax debt. Wife received an order for $1,400 per month on spousal support, kept the engagement ring, and Husband paid Wife’s attorney’s fees.

Attorney Krystal Limon successfully argued a post judgment arrears enforcement on February 28, 2011. This matter was held at the San Diego Superior Courthouse, Family Law Division. Wife retained The Edmunds Law Firm to file for arrears in November 2010.

Husband claimed an oral agreement was made in 2007 to settle spousal and child support arrears and current payments owed in exchange for his payment of enxpenses to the adult children. Since that time the parties did nto dispute that Husband had paid approximately $70,000 in expenses for the adult children. Husband provided two declarations from the adult children confirming the agreement. Husband also raised a Quantum Meruit claim for services rendered to Wife. Wife claimed there was no such agreement. After the hearing on the issue, the Court found there was no agreement and ordered arrearages, including interest, totally approximately $37,000. In addition, the Court denied Husband’s Quantum Meruit claim and ordered attorney’s fees for Wife in the amount of $1,000.

The Edmunds Law Firm successfully stipulated to the dismissal of a restraining order. This matter was held at the San Diego Superior Courthouse, East County Regional Center on December 1, 2010. This case involved a restraining order request. Problems arose in the marriage in early 2010. Petitioner began to periodically vacate the community residence, and then officially moved out in November 2010. Petitioner made claims that Respondent was stalking her, tracking her vehicle, and had hired people to follow her. Attorney Krystal Limon successfully negotiated this matter and all charges and claims brought against Respondent were dismissed.

The case involved a request for change of custody and visitation of a three year old minor. Petitioner was previously awarded 36% custody. On September 10, 2010, The Edmunds Law Firm achieved a huge favorable decision on a family law case. The issues that were presented to the court involved omitted assets from a divorce that occurred two years prior. The omitted assets which were in the possession of the husband, the opposing party, involved several thousands of dollars. Other issues that were litigated included spousal support and the allocation of other financial assets. The case was a difficult case because of the passage of time had created questions in the court’s mind about the request from the wife to take jurisdiction over the omitted asset and divide it amongst the parties.

The Edmunds Law Firm’s presentation in argument as well as through pleadings was persuasive and the court ordered the husband to pay his ex-wife 50% of the value of the omitted assets that were not preivously adjudicated. In addition, the client received a tremendous increase in support and the request for arrears on the support order was granted.

The Edmunds Law Firm represented a client attempting to have her son return home to Nebraska after the opposing party filed a motion for a complete change in custody during a five week visit in San Diego. At an emergency hearing, the Court ordered an expedited trial on the issue and stated that it was inclined to grant the opposing party’s request based on the facts of the case.

At the trial, The Edmunds Law Firm obtained and order denying the opposing party’s request to change custody and ordered that the child return home to Nebraska.

Today, Attorney Edmunds received a court order on a case that had been litigated in the San Diego Superior Court for over two years. The trial concerned a petition to remove a feeding tube from a family member who had been in a coma for over 3 years. Mr. Edmunds represented the Conservator whom was requesting a court order to remove the feeding tube from a woman who had been in a vegetative state with no medical basis for recovery. Family members were divided and emotions ran high. The Judge ruled in favor of Attorney Edmunds and his client. As of this date, no appeal has been filed.

The Edmunds Law Firm recently represented a woman in a Post Judgment hearing involving her request for life insuance as security for payment of spousal support. This client had retained a previous law firm to handle the divorce and there was no provision contained in the Judgment for her to have the security of a life insurance policy in the envent of the untimely, premature death of her ex-husband.

The Edmunds Law Firm, an experienced family law firm in San Diego, accepted representation and filed a request that a life insurance premium be paid by the ex husband to the former wife. The case was favorably resolved with a Stipulation and Court Order that our client receive a monthly payment in addition to spousal support to be used as a premium payment for life insurance.
